Major contents of Decree No.18/2019/ND-CP

Decree No.18/2019/ND-CP of the Government is fully titled “The Decree on the Management and Implementation of the Settlement of Post-war Bomb, Mines and Explosives (UXO) Consequences”.

On February 1, 2019, the Government promulgated Decree No.18/2019/ND-CP on the management and implementation of the settlement of post-war UXO consequences in Vietnam.

Accordingly, the decree regulates the management and implementation of activities related to the overcoming of the consequences of UXO in the territory of the Socialist Republic of Vietnam. The decree applies to domestic agencies, organizations and individuals and foreign organizations and individuals related to the mitigation of post-war UXO consequences in the territory of the Socialist Republic of Vietnam.

The contents of the management and implementation of the settlement of post-war UXO consequences are as follows:

The management and implementation of the UXO consequence settlement include the following contents: Implementation of studies and surveys to collect data, evaluation of the levels of post-war UXO remnants; Conduct of post-war UXO detection and clearance; Organization of post-war UXO information dissemination and education to prevent UXO accidents from occurring; Assistance for victims of UXO accidents; Conduct of training, doing scientific and technological research related to overcoming post-war UXO consequences.

Methods of implementing the settlement of post-war UXO consequences:

The project on the settlement of post-war UXO consequences consists of component projects focusing on carrying out one or more than one activity related to UXO consequence relief regulated in Article 4 of this Decree.

Special projects on post-war UXO consequence remedy include projects on the settlement of post-war UXO consequences in special national relic sites; Projects on post-war UXO consequence settlement in areas of special importance in terms of defense and security in line with the law on national defense and security; Projects on post-war UXO consequence settlement in areas of defense and security classified into the national-level of confidentiality; Projects on post-war UXO consequence settlement related to chemical weapons, toxic substances and extremely dangerous explosives.

Financial sources for post-war UXO remedy activities are from: The State budget (including aid, ODA and concessional loans), business budget, and other lawful financial sources as prescribed by law.

The management and use of the Support fund for post-war UXO consequence mitigation must be for the right purpose, timely, public, transparent, fair and efficient.

Rights of UXO victims: UXO victims are supported by the State with initial medical support, health care, physical rehabilitation, education, vocational training, employment and social protection; Children of UXO victims who are policy beneficiaries from poor or near-poor households or in extremely needy circumstances are supported with scholarships, financial support for buying school supplies as prescribed by law; UXO victims are entitled to the rights of people with disabilities as prescribed by law.

Contents of activities in support of UXO victims: UXO victims are supported by the State with medical care in case of accidents, assisted with health insurance and entitled to health insurance policy according to health insurance regulations; UXO victims are supported with orthopedic operations and physical rehabilitation; UXO victims are supported with education, vocational training and jobs finding; UXO victims are supported with livelihoods and the use of social work services; People living in post-war UXO-contaminated areas are supported with their resettlement and household economic development; Children of UXO victims, who are policy beneficiaries, from poor, near-poor households or in extremely difficult circumstances are supported with their schooling.

Decree No.18/2019/ND-CP takes effect as from March 20, 2019.
